Website Updates & Security
By submitting this form, you agree that website updates, maintenance and security services are provided on a reasonable-efforts basis. While reasonable measures are taken to keep the website updated, secure and operational, no guarantee can be made that the website will remain free from vulnerabilities, errors, downtime, malware or security breaches. No liability is accepted for issues arising from third-party software, plugins, themes, hosting infrastructure or circumstances outside our reasonable control.
Hosting
By submitting this form, you agree that website hosting is provided on a reasonable-efforts basis. Hosting availability and performance cannot be guaranteed, and no liability is accepted for downtime, data loss, security issues, service interruptions or problems arising from third-party hosting infrastructure.
Backups & Data
Reasonable measures may be taken to maintain website backups; however, backups cannot be guaranteed to be complete, current or available in every circumstance. Clients should maintain independent copies of any important content, files or business data.
Google Ads
Google Ads management is provided on a reasonable-efforts basis. No guarantee is made regarding advertising results, impressions, clicks, leads, conversions, rankings or advertising costs. No liability is accepted for changes, errors, account restrictions, suspension or other actions taken by Google or its advertising systems.
Email Delivery
Email delivery is provided on a reasonable-efforts basis. Delivery and inbox placement cannot be guaranteed, and no liability is accepted for emails being delayed, rejected, blocked, filtered as spam or otherwise affected by third-party email systems.
SEO
SEO services are provided on a reasonable-efforts basis. Search engine rankings, traffic, indexing, visibility or other SEO results cannot be guaranteed. Search engines may change their algorithms, policies and ranking systems at any time, and no liability is accepted for changes resulting from search engine actions or other factors outside our reasonable control.
Third-Party Services
Some services may rely on third-party providers, including Google, domain registrars, hosting providers, email providers, plugins, software platforms and other external services. Goji Design is not responsible for outages, policy changes, restrictions, price increases, security incidents or other issues caused by third-party providers.
Client Content & Information
The client is responsible for ensuring that all text, images, logos, documents and other material supplied to Goji Design may legally be used and does not infringe the rights of any third party. The client is also responsible for the accuracy of information supplied for publication.
Scope of Work & Changes
Services will be provided according to the agreed scope of work. Additional work, significant changes or requests outside the agreed scope may incur additional charges. Where practical, additional work will be discussed with the client before being undertaken.
Domain Names
Where Goji Design registers or manages a domain on behalf of the client, the domain remains the client’s property, subject to the relevant registrar’s terms and successful payment of applicable registration and renewal fees. The client is responsible for ensuring domain registration details remain accurate.
Website Ownership & Access
Upon payment of all applicable project fees, the client retains ownership of their website content and agreed custom design work, subject to any third-party software, licences, fonts, stock assets, plugins or other materials that remain subject to their respective licence terms.
Payment
Invoices are payable according to the agreed payment terms. Goji Design reserves the right to suspend services, hosting, advertising management, maintenance or other ongoing services where invoices remain unpaid, subject to any applicable contractual or legal requirements.
Service Suspension
Services may be suspended where required for security reasons, non-payment, misuse, legal requirements or circumstances outside reasonable control. Reasonable efforts will be made to notify the client where practicable.
Client Approval
The client is responsible for reviewing and approving website content, designs, advertising material and other deliverables before publication or launch. Once approved, subsequent changes may incur additional charges.
Results & Performance
While Goji Design aims to provide professional, effective and high-quality services, specific commercial results cannot be guaranteed. Website traffic, search rankings, advertising performance, enquiries, sales, email delivery and other business outcomes can be affected by factors outside Goji Design’s control.
Limitation of Liability
To the extent permitted by law, Goji Design will not be liable for indirect, consequential or business losses arising from website hosting, maintenance, security, SEO, advertising, email delivery, third-party services or other circumstances outside Goji Design’s reasonable control. Nothing in these terms excludes or limits any rights or liability that cannot legally be excluded under applicable law.
Agreement
By submitting this form, you confirm that you have read and understood these terms and agree to them. You authorise Goji Design to provide the services described in your agreement and acknowledge that the services are subject to the terms above.
